Le truc vite fait, je vis en Suisse donc n'ai pas à payer la taxe quand j'importe depuis l'UE car je la paye en Suisse. C'est prévu par les lois européennes.

As this will be delivered to Switzerland, which is outside EU, can you please take the VAT out of this order?
I am not living in EU and therefore do not have to pay the taxes.
In addition Switzerland postal services charges us automatically for importated goods and so I don't want to pay the VAt twice, once in UK and once in Switzerland.

Unfortunately we are unable to remove the vat from the invoice as it has to shown by law. To be reimbursed for the vat charged in Switzerland, please speak to Swiss customs who should be able to advise you on proceeding with a claim

La je rigole un bon coup et je réponds:

I am afraid you are wrong.
I have ordered stuff from UK quite often (through camskill.com, amazon.co.uk, play.com ...) and the VAT deduction was always done by the seller.
Swiss customs won't refund me anything as this has to be done onsite, the refund is made by British customs when you leave the country; this is for a normal sale.
Over the net this is done directly by the seller, you can check on all the websites I mentionned before, by creating an account located in Switzerland, and you will see that the deduction is made directly by the sender, prior to charge the total value.

Furthermore, the french GW website does it as well... You can check by yourself, so it would be tremendous that you'd be the only one to know this law, especially when another website from the same company does it the way I say.

Thanks in advance for getting the right information before answering a wrong one. Nothing has to be shown on the customs invoice if its destination is outside EU.

Thanks in advance for getting back to me when you'll have investigated this issue.

To explain this more clearly, Forge World operates a single price policy so that no matter where you are in the world, a resin kit costs the same amount as is only fair. When you place an order via the Forge World website, your card is charged in Sterling here in the UK, and this means that we are charged tax on the models we dispatch to you – some of this amount goes to offsetting our shipping costs, so we make exactly the same amount from an order from Switzerland as we do from one from any other country in the world.

The reason that the French Games Workshop website modifies your tax accordingly is because ordering from it is the same as buying something in Switzerland, and it is designed to apply local sales tax (or not, as the case may be), because your card is charged at the time of placing the order. This applies to all the websites you mention – because your card is charged as you place the order, the currency and local sales tax etc are applied according to your location. As we charge your card in the UK, this is not the same process.

Unfortunately, we are not responsible for any import duty charged to you by Swiss Customs – as we do not have up-to-date information on what these charges are for every country, we can only advise that you contact your local Customs office prior to placing an order.

Thanks a lot for your answer, though it is quite rethorical. I will try to answer it in chronological order.

First of all I am very moved by FW's will to treat each human living equally and fairly. Unfortunately what you are saying is going against this will. If I buy (or a Japanese people for example) a kit I will have the English VAT + the Swiss (or Japanese one) which will make it more expensive. Fair you say? Of course you're not responsible of Swiss taxes, that's why laws exist in order to avoid double taxation.
By the way, saying that because my card is charged in pounds it means having taxes is just plain nonsense. That has nothing to deal with the problem here.

The second part about the other websites is just plain nonsense as well. :( The location of the seller and where the card is charged has nothing to do with this, the only thing that matters is the destination of the goods.

Finally I do not have to contact my customs as I know exactly what the rules are, e.g any parcel coming from outside Swiss and with a value above 67 CHF will be taxed at 7,6 % + fees, except for book where it goes to 202 CHF.

I'd rather have an honest answer like "listen, the website is not designed to calculate prices without VAT and it's too much hassle to do it manually" than read things you're just coming up with.

Here is the English law; I highlighted what interests us.

A direct export occurs when the complete transaction from supply to export is under the control of the UK supplier or owner of the goods. The location of the customer is not a relevant factor provided the goods are exported under the control of the supplier.

The liability of such supplies is legislated for in Article 146(1)(a) of The Principal VAT Directive 2006/112/EC which allows for the zero-rating of

the supply of goods dispatched or transported to a destination outside the Community by or on behalf of the vendor

Direct exports are defined in section 30(6) of the VAT Act 1994 as follows

A supply of goods is zero-rated by virtue of this subsection if the Commissioners are satisfied that the person supplying the goods –

(a) has exported them to a place outside the member States; or

(b) has shipped them for use as stores on a voyage or flight to an eventual destination outside the United Kingdom, or as merchandise for sale by retail to persons carried on such a voyage or flight in a ship or aircraft,

and in either case if such other conditions, if any, as may be specified in regulations or the Commissioners may impose are fulfilled.

Examples of direct exports include situations where

the UK supplier, or an agent employed by the supplier, eg a freight forwarder, is responsible for the physical export of the goods
the UK supplier sends the goods by post, or
the UK supplier exports the goods in baggage using the ‘Merchandise In Baggage’ (MIB) procedures.

What I suggest: please pass the ball to your accountant or financial Dpt, someone who'll know what he's talking about.
Another suggestion, for FW itself: Redesigning the website so that it calculates the prices without VAT is not that difficult, and by doing so you'll respect your honorable will to treat everyone fairly. Furthermore, by doing so you'll sell more to outside EU customers as they won't pay the tax twice and therefore have a larger budget. That's call merchandising and real customers relations.

Ps: I'm not a pain in the ass, but I know what I'm talking about, and reading this kind of answers saddens me regarding the image of FW.
